A. As used in this section entitled “General Conditions,” the term “publisher”refers to The Target Group, Inc.
B. By placing an order, advertiser and agency agree to the terms and provisionsof the current advertising rate card. Publisher will not be bound by conditions, printed or otherwise, appearing on contracts, order, billing or copyinstructions, including position requests, that conflict with the current ratecard unless specifically agreed to by the publisher in writing.
C. The publisher reserves the right to hold advertisers and/or their advertisingagencies jointly and severally liable for money due and payable to the publisher.
D. The publisher’s liability for any error will not exceed the charge for the advertisement in question. Publisher is not liable for delays in delivery and/ornondelivery by reason of events beyond the publisher’s control.
E. The advertisers index is prepared by the publisher as an extra service to advertisers over and above the space order. The publisher assumes no liabilityfor errors or omissions in key number or advertisers index.
F. Rates are subject to change on notice from publisher. Advertisers may cancel or amend schedule without incurring short-rate adjustment at time raterevision becomes effective.
G. The parties agree and covenant that in any dispute arising out of, under orby virtue of the contract between them, said dispute shall be settled solelyand only by resort to arbitration before the American Arbitration Association, Los Angeles office, only, and the result of the arbitration shall bebinding and final, with no appeal. The arbitration shall be conducted in accordance with the Commercial Rules of Arbitration then in effect, togetherwith the applicable provisions of the California Code of Civil Procedure.Discovery shall be limited to one set of interrogatories, not to exceed 35questions, and one document production request,not to exceed 15 categories.
There shall be no other discovery.
H. Advertising that simulateseditorial content mustcarry the word “advertisement” at top of ad.

Each page or fractional page counts as oneinsertion, as do units within a multiple-page advertisement. Two-pagespread counts as two insertions toward the fulfillment of contract. Combination rates apply for all ads placed in Target Group publications.

Classified ads are available at a rate of $150 per inch, 4" maximum. All classifieds must be prepaid. Noncommissionable.
H. Issue and Closing Dates: Issued bimonthly. All space orders and materialsare due on the dates noted in the editorial calendar. Cancellations are notaccepted after closing.
I. Commissions:a. Agency commission 15% of gross billing to recognized agencies onspace, color and position, provided account is paid within 30 days of invoice date. Other charges such as insert handling, special binding or trimming of inserts, reprints or other mechanical charges arenoncommissionable.b. All invoices are due and payable within 30 days from invoice date.
J. Rate Protection is available; contact your advertising representative for details.
K. Short Rates and Rebates: Short-rate bills will be rendered immediatelyupon cancellation of contract or failure to fulfill minimum frequency requirements. Rebates are earned by using additional space within a 12-month period to justify a lower rate than that billed. Rebates will becredited to the advertiser.
